Legislative function: adoption of amendments to the Constitution, laws and other legal acts

The National Assembly is the highest representative and legislative body in the country, which:

  • adopts constitutional acts amending the Constitution of the Republic of Slovenia,
  • adopts laws, authentic interpretations of laws and official consolidated texts of laws,
  • adopts ordinances, resolutions, declarations, recommendations and decisions,
  • adopts the Rules of Procedure of the National Assembly,
  • adopts the state budget, the supplementary state budget, amendments to the state budget and the annual financial statement of the state budget,
  • ratifies treaties,
  • calls referendums: referendums on a constitutional amendment, legislative referendums, consultative referendums, referendums on the establishment of municipalities, referendums on international integrations,
  • discusses EU affairs.

 

The competences of the National Assembly are defined in Chapter IV of the Constitution of the Republic of Slovenia.
The National Assembly adopts laws. Draft laws may be tabled by the Government, any deputy, at least five thousand voters and the National Council.  

 

 

Within the scope of its electoral function, the National Assembly elects, appoints and dismisses the most important holders of public offices in the National Assembly, the Government, the Constitutional Court, and other institutions in accordance with the Constitution and laws. The National Assembly elects and appoints:

  • the President and Vice-Presidents of the National Assembly,
  • the Secretary General of the National Assembly,
  • the Chairs and Deputy Chairs of National Assembly working bodies,
  • the President of the Government and ministers,
  • Constitutional Court judges and other judges,
  • the Human Rights Ombudsman,
  • five members of the Judicial Council,
  • the governor of the Bank of Slovenia,
  • the members of the Court of Audit,
  • other holders of public office, where so provided by law. 

 

The Constitution provides that the President of the Government is elected by the National Assembly by secret ballot. The election is held on the proposal of the President of the Republic. The President of the Government is elected by a majority vote of all deputies, meaning at least 46 votes in voting. If the candidate does not receive the necessary number of votes on the first ballot, Article 111 of the Constitution defines further procedure.

Supervisory function: parliamentary inquiry, vote of confidence and no confidence, impeachment before the Constitutional Court, parliamentary questions and motions

Within the scope of its supervisory function, the National Assembly:

  • orders a parliamentary inquiry,
  • decides on the vote of confidence and no confidence in the Government,
  • decides on the impeachment of the President of the Republic, the President of the Government and ministers before the Constitutional Court,
  • tables parliamentary questions and motions to the President of the Government, ministers and Secretary General of the Government. 

 

The procedures for implementing the legislative, electoral and supervisory functions are defined in the Rules of Procedure of the National Assembly.

Other competences of the National Assembly: pursuant to the Constitution, laws and the Rules of Procedure of the National Assembly

The National Assembly also performs other tasks provided by the Constitution, laws, the Rules of Procedure and other acts of the National Assembly. Among the most important are:

  • deciding on the declaration of war or state of emergency, and the use of defence forces,
  • confirming the election of deputies,
  • deciding on the immunity of deputies, Constitutional Court judges, judges, and the Ombudsman and Deputy Ombudsmen.

 

The National Assembly is the highest representative and legislative body in the Republic of Slovenia. Its basic task is to perform the legislative function under which deputies adopt the most important national legal acts. In addition, the National Assembly performs electoral and supervisory functions. The National Assembly is also the holder of other functions performed by modern democratic parliaments: it represents social interests, resolves conflicts of interest, adopts the Constitution of the Republic of Slovenia, adopts and controls the state budget, and is the creator and holder of legitimacy.
